These Terms and Conditions ("Terms") govern your use of the Nek Humsafar Matrimony Android application (package name com.nekhumsafar.matrimony), humsafarapka.com, nekhumsafar.com and related services (together, the "Service") operated by Nek Humsafar. Please read them before registering or using the Service.
1. Acceptance of these Terms
By creating an account, accepting these Terms in the app, visiting authenticated features or purchasing a benefit, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. A separate payment or platform provider may also apply its terms to a transaction it processes.
2. Eligibility: adults only
You must be at least 18 years old, legally capable of entering a binding agreement, and legally eligible to seek marriage under the laws applicable to you. Profiles for minors are prohibited. If you create or manage a profile for an adult relative, you confirm that you are authorised to do so, that the profiled adult is at least 18, and that you have their informed consent to provide and manage their information.
3. Account registration and security
- Provide current, accurate and non-misleading information and keep it updated.
- Create only accounts you are authorised to create and do not impersonate another person.
- Keep passwords and OTPs confidential and promptly report suspected unauthorised access.
- You are responsible for activity conducted through your account until you notify us of unauthorised use.
- Verification badges or checks indicate that a stated check was completed; they are not a guarantee of identity, character, background, compatibility or intent.
4. Matrimonial purpose
Use the Service only for genuine, lawful matrimonial discovery and related communication. Nek Humsafar provides tools for introductions and does not arrange, promise or guarantee a match, engagement or marriage. You remain responsible for independent enquiries, consent, personal decisions, meetings and transactions with another member.
5. Your profile and content
You retain ownership of lawful text, photos, audio and other content you submit. You give Nek Humsafar a limited, non-exclusive, worldwide licence to host, reproduce, format, transmit and display that content only as needed to operate, secure, moderate and improve the Service. This licence ends when the content or account is deleted, except for content already delivered to another user, protected backups, safety evidence and records we must lawfully retain.
You confirm that you have the necessary rights and consent for every person's information or image you upload. Do not publish an address, financial credential, government ID number, private intimate image or other information that could expose you or someone else to harm. Profile content may be visible to other eligible members according to your settings and Service rules.
6. Prohibited conduct and content
You must not use the Service to:
- impersonate, deceive, defraud, scam, extort or solicit money, gifts, investments or banking credentials;
- harass, threaten, stalk, bully, blackmail or promote hatred, violence or discrimination;
- post nudity, sexually explicit material, non-consensual intimate content, escort services, paid sexual arrangements, "sugar dating" or sexual solicitation;
- create a profile for a minor, target or sexualise a minor, groom a child, or create, possess, request, distribute or facilitate child sexual abuse material;
- upload false, stolen, unlawful, infringing, malicious or privacy-invasive content;
- send spam or commercial advertising, harvest contact details, scrape profiles, copy databases, use bots, reverse engineer security, or attempt unauthorised access;
- circumvent a block, suspension, payment rule, verification step, profile control or technical restriction; or
- use information obtained through the Service for employment, credit, housing, surveillance, public shaming or any purpose unrelated to genuine matrimony.
7. User-generated content, reporting and moderation
The Service contains user-generated profiles and communications. If you encounter a suspicious account, objectionable content or misconduct, use the in-app Report or Block control or email info@humsafarapka.com. Provide the Matrimony ID, a description and safe supporting evidence; do not continue engaging with a person who makes you feel unsafe.
We may review reports and relevant content, use automated or human moderation, reduce visibility, remove content, restrict features, suspend or close accounts, preserve evidence and cooperate with competent authorities. We may act without advance notice where needed for safety, law, fraud prevention or enforcement. Moderation decisions may consider context and available evidence, and you may contact support to request review.
8. Child safety standards
Nek Humsafar has zero tolerance for child sexual abuse and exploitation (CSAE), including child sexual abuse material (CSAM). The Service is strictly for adults aged 18 and over. We prohibit grooming, sexualisation of minors, sextortion, trafficking, requests for sexual content involving a minor, and any content or conduct that exploits or endangers a child.
Report a possible child-safety violation immediately through the in-app reporting tool or email our child-safety contact at info@humsafarapka.com. Do not download, forward or attach suspected illegal imagery to an email. Instead, provide the account's Matrimony ID, where the content appeared and a factual description.
We investigate reports, remove or disable violating content and accounts, preserve relevant evidence, and report apparent CSAM or child exploitation to the appropriate law-enforcement or child-protection authority where required by law, including the National Center for Missing & Exploited Children when applicable. We will also respond to lawful requests from competent authorities.
9. Member safety and offline meetings
Use caution and independent judgement. Never share an OTP, password, full government ID, CVV or banking password, and do not send money to someone merely because you met through the Service. Before meeting, verify the person's information, tell a trusted person, meet in a public place and arrange your own transport. Contact local emergency services if anyone is in immediate danger. Nek Humsafar is not responsible for a member's statements or off-platform conduct, but we encourage prompt reporting so we can take platform action.
10. Memberships, payments, renewals and refunds
- Prices, duration, benefits and whether a purchase renews are shown before payment. Digital benefits may activate after confirmed payment.
- Purchases made through Google Play are subject to Google Play's billing, cancellation and refund rules. If a recurring subscription was purchased through Google Play, manage or cancel it in your Google Play subscriptions settings.
- Where another payment method is expressly and lawfully offered, the displayed payment provider's terms also apply. Never share a payment OTP, CVV or banking password with us or another member.
- Cancellation stops future renewal but ordinarily does not reverse a period or benefit already supplied. Closing or deleting an account does not automatically create a refund.
Refund eligibility, failed or duplicate payments and unused benefits are explained in our Payment & Refund Policy. Mandatory rights under applicable law are not excluded.
11. Communications and app permissions
We may send essential account, security, payment and safety notices. Optional match, promotional or reminder communications are controlled by available settings and consent choices. Camera, photos or storage, microphone, location and notification permissions are requested for the related features; you can manage them in Android settings, though disabling a permission can limit that feature.
12. Intellectual property
The Service's software, design, branding, databases and original content, excluding member content, belong to Nek Humsafar or its licensors and are protected by applicable law. These Terms give you a personal, limited, revocable, non-transferable right to use the Service for its intended purpose. No right to copy, resell or commercially exploit the Service is granted.
13. Suspension, termination and deletion
You may stop using the Service, deactivate your profile, or submit our public account deletion request form. Deletion and limited-retention details are described in the Account and data deletion section of our Privacy Policy. We may restrict or terminate access for a Terms violation, safety risk, fraud, unlawful conduct, non-payment or misuse. Where appropriate, we may notify you and allow a review request; urgent safety or legal action may occur immediately.
14. Service availability and disclaimers
The Service is provided on an "as available" basis to the extent permitted by law. We work to keep it secure and useful but do not guarantee uninterrupted access, error-free operation, the accuracy of member-provided information, the outcome of a verification, compatibility, conduct, or a successful marriage. Nothing in these Terms limits a warranty or consumer right that cannot legally be excluded.
15. Limitation of liability
To the maximum extent permitted by applicable law, Nek Humsafar is not liable for indirect, incidental, special or consequential loss arising from member content, off-platform dealings, unauthorised use caused by your failure to protect credentials, or events outside our reasonable control. This does not exclude liability that cannot legally be limited, including liability arising from fraud or wilful misconduct.
16. Applicable law and disputes
These Terms are governed by the laws of India, without overriding any mandatory consumer protection that applies to you. Please first contact us so we can try to resolve a concern. Any unresolved dispute will be handled by a court or forum having lawful jurisdiction.
17. Changes and severability
We may update these Terms when the Service or law changes. The current version will be posted at this public URL with its updated date, and material changes will be communicated where required. If one provision is held unenforceable, the remaining provisions continue to apply. Our failure to enforce a provision once is not a waiver.
